  • Offer, bid, and transaction history
  • Inquiry and messaging content
  • Reviews and feedback submitted

2.4 Payment Information

  • Subscription billing details (card type, last 4 digits, expiry — full card numbers are never stored by OzMoto)
  • Payment transaction references and histories
  • All payment card data is processed and stored securely by Stripe (a PCI DSS-compliant payment processor)

2.5 Technical and Usage Information

  • IP address and approximate geographic location
  • Browser type, version, and operating system
  • Device identifiers and mobile device information
  • Pages visited, search queries, and platform interactions
  • Referral source and session duration
  • Cookies and similar tracking technologies (see Section 8)

2.6 Communications

  • Messages exchanged between users on the Platform
  • Support requests and correspondence with OzMoto
  • Feedback, survey responses, and dispute submissions

Where it is lawful and practicable, we will collect personal information directly from you. If we collect information about you from a third party, we will take reasonable steps to notify you of that collection.

We use your personal information only for purposes that are related to our functions and activities, or for purposes to which you have consented. These include:

  • Processing subscription payments and billing
  • Verifying user identity for auction participation

  • Improving Platform features and user experience through analytics
  • Personalising your browsing experience and recommendations
  • Detecting and preventing fraud, abuse, and security threats
  • Complying with legal and regulatory obligations
  • Conducting internal research and reporting
  • Sending marketing communications (only with your consent — see Section 10)

We will not use your personal information for a purpose other than those listed above without your consent, unless permitted by the Privacy Act 1988 (Cth).

5.1 Other Platform Users

Your public profile information, listings, and reviews are visible to other users to facilitate transactions. Your contact details are only shared with other users when you choose to do so (e.g. by responding to an inquiry or accepting an offer).

5.2 Service Providers

We engage trusted third-party service providers who assist us in operating the Platform. These include:

  • Stripe — payment processing (PCI DSS compliant)
  • Google — analytics (Google Analytics), maps (Google Maps API), and tag management (Google Tag Manager)
  • Meta (Facebook) — advertising pixel and social sharing features
  • Microsoft Clarity — user session analytics
  • Algolia — search infrastructure
  • Resend / Twilio — email and SMS notifications
  • Base44 — platform infrastructure and hosting
  • OpenAI — AI-powered assistant features

All service providers are required to handle your personal information in accordance with this Policy and applicable privacy laws. Some providers may be located overseas (see Section 9).

5.3 Legal Requirements

We may disclose personal information when required or authorised by law, including in response to a court order, subpoena, or request from a government or law enforcement agency, or to protect the rights, property, or safety of OzMoto, our users, or the public.

5.4 Business Transfers

In the event of a merger, acquisition, sale of assets, or corporate restructure, your personal information may be transferred to the relevant third party. We will notify you via email or platform notification before such a transfer occurs and, where applicable, give you the opportunity to withdraw consent.

5.5 AUSTRAC and Fraud Prevention

We may disclose information to the Australian Transaction Reports and Analysis Centre (AUSTRAC) or other relevant authorities where required under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

6. Data Security

We take all reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. Our security measures include:

  • TLS/HTTPS encryption for all data transmitted to and from the Platform
  • Encrypted storage for sensitive personal data
  • Strict access controls — only authorised personnel can access personal data

Data Breach Notification: In the event of an eligible data breach as defined under the Notifiable Data Breaches (NDB) scheme (Part IIIC of the Privacy Act 1988 (Cth)), OzMoto will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.

7. Data Retention

We retain your personal information for as long as necessary to fulfil the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention periods include:

  • Account data: Retained for the duration of your account plus 7 years after closure (to comply with Australian tax and financial record-keeping requirements)
  • Transaction records: Retained for 7 years as required by Australian taxation law
  • Identity verification documents: Retained for the minimum period required by applicable law and then securely destroyed
  • Support communications: Retained for 3 years from the date of the communication
  • Inactive accounts: May be deleted after 3 years of inactivity, with at least 30 days' prior notification

When personal information is no longer required, we will take reasonable steps to destroy or de-identify it in a secure manner.

We use cookies and similar tracking technologies to operate the Platform, improve your experience, and for analytics and advertising purposes.

9. Overseas Disclosure of Personal Information

Some of our service providers are located or store data outside of Australia. Countries where your personal information may be processed or stored include the United States of America (Stripe, Google, Meta, OpenAI, Algolia) and other countries where our technology providers maintain data infrastructure.

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the overseas recipient does not breach the Australian Privacy Principles. However, by using the Platform, you acknowledge that where we have taken such steps, we are not required to take further steps to ensure compliance with the APPs by the overseas recipient (APP 8.2).

If you do not consent to the disclosure of your personal information to overseas recipients, please contact our Privacy Officer — however, please note that this may limit your ability to use certain features of the Platform.

10. Marketing Communications and Spam Act Compliance

OzMoto complies with the Spam Act 2003 (Cth). We will only send you commercial electronic messages (including email and SMS) where:

  • You have provided express or inferred consent to receive them, or
  • We have an existing relationship with you and the message is directly related to that relationship

Every marketing communication we send will include a clear, easy-to-use unsubscribe mechanism. You can also update your communication preferences in your Account Settings or by visiting our Contact Page.

Please note that even if you opt out of marketing communications, we will still send you essential transactional messages (e.g. billing confirmations, security alerts, listing updates).

11. Your Rights Under Australian Privacy Law

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the following rights:

11.1 Access to Your Information (APP 12)

You have the right to request access to the personal information we hold about you. You can access much of your information directly through your account settings. For a complete record, submit a written request to our Privacy Officer. We will respond within 30 days. We may charge a reasonable fee for access where permitted by law.

11.2 Correction of Your Information (APP 13)

You have the right to request correction of any personal information we hold that is inaccurate, incomplete, out-of-date, irrelevant, or misleading. We will respond to correction requests within 30 days.

11.3 Account Deletion

You may request deletion of your account and associated personal data through your Profile settings (Request Account Deletion) or by contacting us. Please note that certain data may be retained for legal compliance purposes (see Section 7).

11.4 Data Portability

Upon request, we will provide you with a copy of your personal information in a commonly used, machine-readable format where reasonably practicable.

11.5 Withdrawal of Consent

Where we rely on your consent to process personal information, you may withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of processing carried out before the withdrawal.

11.6 Anonymity and Pseudonymity (APP 2)

Where lawful and practicable, you may interact with OzMoto anonymously or under a pseudonym. However, please note that most Platform features (including listing, bidding, and purchasing) require a verified identity.

12. Sensitive Information

We generally do not collect sensitive information (as defined by the Privacy Act 1988 (Cth)), such as racial or ethnic origin, political opinions, religious beliefs, health information, criminal records, or biometric data. The only exception is government-issued identification documents collected as part of our auction identity verification process. Such documents are collected solely for the purpose of identity verification and are handled with the highest level of security and confidentiality.

13. Children's Privacy

The OzMoto Platform is not directed at or intended for use by individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected personal information from a person under 18, we will take immediate steps to delete that information. If you believe a minor has submitted personal information to us, please contact our Privacy Officer immediately.

14. Third-Party Links and Platforms

The Platform may contain links to third-party websites, social media platforms, and services. This Policy does not apply to those third-party sites. We recommend you review the privacy policies of any third-party websites you visit. OzMoto is not responsible for the privacy practices of third-party sites.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. Where changes are material, we will notify you by email or platform notification at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.

16. Privacy Complaints

If you believe we have not complied with our privacy obligations or have handled your personal information in breach of the Australian Privacy Principles, you may lodge a complaint as follows:
